The purpose of this paper is to set out the case for a new kind of problem-solving court for New Zealand, called a Management Court. The model is what I think could most effectively and efficiently work in the NZ context. It is one that compliments rather than conflicts with our existing criminal justice system. I also believe that overall it would save us a fortune as it would be a real and viable alternative to imprisonment in a large number of cases.

Like many ‘legal’ issues, the concept of making judges accountable for their mistakes involves a tension, if not an outright conflict of admirable principles. On the one hand a Judge who is not up to the job should be able to be held to account and in extreme cases even sacked. On the other hand however it is a fundamental and foundation principle of our system of government that the judiciary is independent and immune to public or political interference.

Greg King has written on the American 'stand-your-ground' doctrine as compared to New Zealand's law on self defence.
